Former Law Society of Kenya (LSK) president Nelson Havi has been found guilty of professional misconduct by the Advocates Disciplinary Tribunal. The tribunal’s ruling follows a complaint lodged by fellow former LSK president, Allen Waiyaki Gichuhi, over statements Havi made on social media which were deemed defamatory.

In its decision, the Tribunal concluded that Havi’s remarks amounted to a breach of the ethical and professional standards expected of advocates in Kenya. The case revolved around several posts published by Havi on platforms such as X (formerly Twitter), in which he made allegations against Gichuhi that the Tribunal found were not only unsubstantiated but also damaging to Gichuhi’s professional standing and reputation.

The complaint, first filed in 2021, alleged that Havi’s conduct was unbecoming of a person holding the office of LSK president and violated the Advocate’s Code of Conduct. “The legal profession demands a high level of integrity and ethical conduct from its members, more so from those in leadership positions,” the Tribunal noted in its statement. “Mr. Havi’s actions, in this instance, fell short of these expectations and therefore constitute professional misconduct.”

While the Tribunal has yet to announce the sanctions that Havi will face, the ruling itself is seen as a significant development in the ongoing effort to uphold discipline and integrity within the Kenyan legal system. “I welcome the Tribunal’s ruling, not out of personal satisfaction, but in the hope that it will reinforce the need for respectful discourse within our profession. Social media is a powerful tool, but when misused, it can cause real harm,” he said.

Havi, known for his outspoken nature and controversial statements, has yet to issue a formal response to the ruling. However, his supporters argue that the Tribunal’s decision could have a chilling effect on free speech within the legal fraternity.

This case marks one of the most high-profile disciplinary matters involving senior members of the LSK in recent years, and it may set a precedent for how similar complaints are handled in the future.
