Family Sues State Over Alleged Abduction of Eastleigh Businessman

The family of Nairobi businessman Abdi Aidid Ali has filed a case against the Government of Kenya, alleging that he was forcibly abducted by masked security officers in Eastleigh.

The legal action was filed through lawyer Mwaura Wakabata of Alakonya & Associates, who claims the petitioner was taken by men believed to be officers from the Inspectorate General of Police and the Directorate of Criminal Investigations.

Details of the Alleged Abduction

According to court documents, the incident occurred on March 7, 2026, at approximately 7:40 pm along Mohammed Yusuf Haji Avenue (formerly 1st Avenue).

“My client was forcibly removed from his vehicle, registration KDJ 941F, by masked men who have since refused to reveal his location,” Wakabata stated.

The petition argues that more than 48 hours have passed without the family being informed of Ali’s whereabouts. He has neither been taken to a police station nor produced before a court.

“This is a serious violation of his constitutional rights to life, liberty, and dignity,” the documents read.

Court Orders Sought

The family is now seeking urgent orders from the High Court at Milimani, directing the authorities to disclose Ali’s location and produce him before the court.

“Every day that passes without knowing where he is puts his life at risk and causes extreme anguish to his family. We are asking the court to intervene immediately to prevent further violations and ensure justice is served,” the petition states.

The case has been filed under Articles 19, 20, 21, 22, 25, and 258 of the Constitution of Kenya. It also calls for Ali’s unconditional release pending any charges and demands a thorough investigation into the alleged abduction.

Lawyer Calls for Rule of Law

Wakabata emphasized that the case is about upholding the rule of law and ensuring no individual is above the Constitution.

“This is not just about my client; it is about upholding the rule of law and ensuring that no person is above the Constitution,” he said. “We urge the court to act swiftly so that the perpetrators are held accountable.”

About Abdi Aidid Ali

Ali is the owner of ATIS Hotel and another branch in Parklands. The family describes him as a well-known philanthropist, noting his support for several community initiatives in Eastleigh, including contributions to the construction of the California Police Station.

His son stated that if the government required his father, it could have summoned him legally. The family remains uncertain whether the 52-year-old is in the hands of government agents or criminals.

This case has drawn significant public attention, raising concerns over extrajudicial actions and the protection of citizens’ constitutional rights in Kenya.
