Tuju Seeks Anticipatory Bail, Cites ‘Constant Threat of Arrest’

Former Cabinet Secretary Raphael Tuju has moved to the High Court seeking anticipatory bail, citing what he describes as a constant threat of arrest and harassment by state agencies.

In an ex-parte application filed under a certificate of urgency, Tuju argues that law enforcement officers have persistently targeted him, raising concerns over his safety and ability to access medical care.

Claims of Surveillance and Harassment

According to court documents, Tuju claims that on March 21, he was trailed by unmarked vehicles, forcing him to abandon his car and seek refuge at a secure location.

He later presented himself at Karen Police Station to record a statement. However, he alleges that officers manhandled him during the process, worsening injuries he had previously sustained in an aeroplane and motor vehicle accident.

Bid to Block Arrest and Police Action

Through his application, Tuju is seeking court orders to restrain the Inspector General of Police, the Directorate of Criminal Investigations (DCI), and the Office of the Director of Public Prosecutions (DPP) from summoning, arresting, or otherwise interfering with his freedom of movement.

He is also asking the court to guarantee that he can continue receiving medical treatment without intimidation or police presence.

Hospital Stay Under Guard

Tuju was transferred to Karen Hospital on Tuesday morning, where he remains under continuous police guard despite not having been formally charged.

His legal team argues that maintaining him under custodial watch in a hospital setting is inhumane, unjustified, and a violation of his constitutional rights to liberty and proper medical care.

Willingness to Cooperate

The former CS maintains that he is a law-abiding citizen and is willing to cooperate fully with authorities, provided due process is followed.

“In the event the 1st applicant is granted bail, he is willing to appear in court or the police once he is summoned,” court documents state.

Urgent Plea to the Court

The application underscores the urgency of the matter, pointing to Tuju’s fragile health condition and what his lawyers describe as credible fears for his safety.

The High Court is now expected to determine whether to grant anticipatory bail as investigations and legal proceedings continue.
