A Dutch national, identified as Elwin Ter Horst, will remain in police custody for 14 days after a video surfaced showing him verbally attacking, humiliating, and spitting at a police officer at the Diani Police Station in Kwale County.
The suspect appeared before Kwale Senior Resident Magistrate Joy Mutimba on Thursday, where the prosecution requested additional time to complete investigations.
According to Senior Assistant Director of Public Prosecutions (SADPP) Rosemary Nandi, detectives are investigating several offences, including assault, malicious damage to property, resisting arrest, and suspected drug-related activities.
“The prosecution sought 14 more days to allow investigators to finalize their probe into multiple offences linked to the suspect,” the Office of the Director of Public Prosecutions (ODPP) said in a statement.
Magistrate Mutimba granted the application, directing that the accused be detained at Port Police Station pending the completion of investigations.
In addition to the altercation with police, Ter Horst is also accused of assaulting his Kenyan girlfriend, identified as Angela Atieno, in a separate incident. The ODPP confirmed that both matters are being handled concurrently by investigators in Kwale County.
The case will be mentioned on November 13, 2025, when the prosecution is expected to update the court on the progress of the investigations and determine whether formal charges will be filed.
